Age of Consent

Age of Consent
In Scotland it is legal for men and women to have Sex once they are over 16 years of age.  
It is legal for men to have sex with men if they are both over 16 years of age.
There are no specific laws in Scotland about women having sex with women, so provided both women consent and are above the age of consent, it is legal.  


Group sex
Group sexual activity is legal, regardless of gender and/or number participating as long as:

  • Those involved are over the age of consent, except where an older person (18 years and above) is in a position of care and has sex with a 16 or 17 year old within their care i.e. position of care within residential setting.  (This does not apply if the older person is in either a civil partnership or marriage with the younger person).
  • Those involved have consented to the activity
  • The activity is done in private
  • The activity does not involve sex between close relatives
